01Acceptance of these terms
These Terms of Use ("Terms") govern your access to and use of the TimeToSchool web ERP and mobile applications for management, staff and parents (the "Services"), provided by TimeToSchool ("we", "us", "our"). By creating an account, or by accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
02Who may use the Services
The Services are intended for schools and educational institutions and their authorised users — management, teaching and non-teaching staff, and parents/guardians. Accounts are created for a specific school. Students who are minors may use the Services only under the supervision and with the consent of a parent/guardian and the school. You are responsible for ensuring you are authorised to use the account assigned to you.
03Accounts and security
You must provide accurate information and keep your login credentials confidential. You are responsible for activity that occurs under your account. Notify us promptly of any unauthorised use or security breach. We may suspend accounts that appear compromised or that violate these Terms.
04Roles and responsibilities
Where a school subscribes to the Services, the school is responsible for the data it collects and enters, for obtaining any consents required from parents/guardians, for managing user access within its institution, and for the accuracy of the records it maintains. TimeToSchool provides the platform and processes data on the school's instructions, as described in the Privacy Policy.
05Acceptable use
You agree not to:
- use the Services for any unlawful purpose or in violation of any applicable law;
- access data you are not authorised to access, or attempt to breach security or authentication;
- upload malicious code, or interfere with or disrupt the Services or their infrastructure;
- copy, modify, reverse-engineer, resell or create derivative works from the Services except as permitted by law;
- use the Services to store or transmit content that is unlawful, harmful, or infringing; or
- misuse personal data of students, parents or staff accessible through the Services.
06Subscriptions and fees
Access to the Services may be provided under a subscription or other commercial arrangement agreed between TimeToSchool and the school. Applicable fees, billing terms and the scope of features are set out in that agreement or order. Unless stated otherwise, fees are exclusive of applicable taxes. Where fee payment features are used, payments are handled by a third-party payment gateway.
07Intellectual property
The Services, including all software, design, text, graphics, logos and trademarks (including the TimeToSchool name and logo), are owned by TimeToSchool or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services for their intended purpose during your subscription. Data that a school enters remains the school's; you grant us the rights needed to host and process it to provide the Services.
08Third-party services
The Services integrate third-party providers (for example, hosting, notifications, payment processing and maps). Your use of those features may be subject to the third parties' terms. We are not responsible for third-party services, but we select providers that meet appropriate standards.
09Availability and changes
We aim to keep the Services available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, update or discontinue features, and perform maintenance, from time to time. We will make reasonable efforts to limit disruption and to give notice of significant changes.
10Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will meet every requirement or be free of errors.
11Limitation of liability
To the maximum extent permitted by law, TimeToSchool will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, revenue or goodwill, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services will not exceed the fees paid for the Services in the twelve months preceding the claim.
12Indemnification
You agree to indemnify and hold TimeToSchool harmless from claims, damages and expenses arising from your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.
13Suspension and termination
We may suspend or terminate access if these Terms are breached, if required by law, or to protect the Services or their users. A school may end its subscription in accordance with its agreement. On termination, your right to use the Services ends; provisions that by their nature should survive (such as intellectual property, disclaimers and limitation of liability) will survive.
14Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-laws principles. The courts at [City, State — to be completed] will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, subject to any applicable arbitration agreement between TimeToSchool and a school.
15Changes to these terms
We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the Services. Your continued use of the Services after changes take effect means you accept the revised Terms.
